Election Petition: Pre-trial set for January 19

The Pre-trial for the 2020 presidential election petition filed by Former President, John Dramani Mahama has been set for Tuesday, January 19, 2021.

This was after the Supreme Court granted application by the legal team of John Mahama to correct a mistake in the election petition which seeks to challenge the outcome of the December polls.

The Supreme Court started the hearing on Thursday, January 14, 2021.

Relief (f)of Mahama’s election petition mistakenly asked the court to compel the Electoral Commission Chair, Jean Mensa to conduct a re-run of the presidential election between Mr Mahama and the EC instead of between Mr. Mahama and President Akufo Addo.

Despite initial objection by the lawyers of the EC and the president, the  Seven member panel granted the application, saying it is harmless and will not have any impact on the substantive case.

Mr. Mahama’s legal team is required to file the amendment by 4pm Thursday and serve same to both the first and the second respondents, who must in turn file their amendment by 4 pm Friday.

The petitioner, John Mahama and his legal team, the Chairperson of the Electoral Commission and her two deputies (first respondent) were also present for the hearing of the case.

The Supreme Court panel for the petition are Chief Justice Anin Yeboah (Presiding), Yaw Appau Marful Sau, Nene Amegatcher, Prof Kotey, Mariama Owusu and Getrude Torkonoo.
