Asiedu Nketia’s calculations caused Mahama’s defeat- NDC Lawyer

A legal practitioner associated with the National Democratic Congress (NDC), Lawyer John Owusu Agemang says the way Asiedu Nketia answered the court with his calculations as a witness created problems for the petitioner.

According to him, the calculations made by Asiedu Nketia did not contradict what the EC Chairperson stated but rather confirmed the results posted by the EC Chair.

The Supreme Court per a unanimous decision delivered on Thursday affirmed Nana Addo Dankwa Akufo-Addo as a validly elected President of Ghana.

The court said the petitioner, Mr John Dramani Mahama did not demonstrate in any way how the alleged errors made by the Electoral Commission (EC) in the declaration of the presidential election result by the chairperson of the EC, Mrs Jean Adukwei Mensa affected the outcome of the election.

In effect, the Supreme Court said there is no reason to order a re-run, as one of the reliefs by Mr Mahama and dismissed the petition as having no merit.

Speaking on Atinka TV’s morning show, Ghana Nie, hosted by Ekourba Gyasi Simpremu, Lawyer John Owusu Agemang also noted that Asiedu Nketia said they were relying on Jean Mensa’s results and could not provide anything to contradict it or show her results was wrong as they claimed.

“With the way Mahama’s Star witness, Asiedu Nketia answered the questions in court, I did not believe it will go well,” he said.

“Asiedu Nketia, You said Nana Addo did not win the election, Jean Mensa did not do well by declaring Nana as winner of the election, and the court asked you your result and you say you did not bring it. Were you serious? Does it mean you had no basis for coming to court? “the Lawyer Quizzed.

The NDC Lawyer also said during the cross examination, when Asiedu Nketia was asked by Lawyer Akoto Ampaw if he admits Nana Addo had 51.2 percent, and Asiedu admitted it without giving a follow up explanation to contradict the answer.

“If you admitted that Nana had 51.2 percent, then it means Nana had more than 50 percent and had won. The NDC’s case had fallen flat because Asiedu admitted the figures Jean Mensa brought,” the Lawyer said.

The NDC Lawyer again said aside Asiedu Nketia, none of the witnesses were able to bring out figures to contradict what the EC Chair stated, adding that “when you do that you will not win the case.”

“You have to prove your case to show the person is at fault, but with this, we did not prove our case without any established facts from our own calculations. Who amongst all our three witnesses was able to prove results from our own calculations that contradict that of Jean Mensa, none! Not even one, “he said.

He said although John Mahama had a case, the way he presented it to the court also led to his defeat.
